Memorandum of Understanding between Fundação de Amparo à Pesquisa do Estado de São Paulo, Brazil, Fundação de Amparo à Ciência e Tecnologia do Estado de Pernambuco, Brazil and Agence Nationale de la Recherche, France on Joint Calls for Joint Research Projects

“FACEPE”),Brazil,

Agence Nationale de la Recherche (hereinafter referred to as “ANR”), France
referred to hereafter as “the Parties”.
The purpose of this Memorandum of Understanding (MoU) is to foster French-Brazilian collaboration in scientific research and it aims to fund joint research projects conducted by teams from both countries.
This MoU sets out the principles and procedures to be adopted by the Parties in:
a) opening call for proposals;
b) receiving joint proposals;
c) setting up peer review and selection procedures;
d) providing funding for the proposals selected
1 General Description and context
a) FAPESP, FACEPE and ANR have agreed to establish a scheme for joint funding of Brazilian-French collaborative research and innovation projects in Global Change.
b) The aim of the funding cooperation is to strengthen the collaboration between Brazilian and French scientists to achieve world-class scientific and technical results, leading towards new innovative technologies. The Parties welcome, encourage and support joint research which involve research teams from research organisations inFranceand the Brazilian states ofSão Pauloand Pernambuco.
2 Submission of Proposals
a) ANR will receive joint proposals within its national calls for proposals “Changements Environnementaux Planétaires et Sociétés” or “Blanc International / Environment, Earth and Space ”, and will encourage submission of French-Brazilian projects.
a.1) ANR will precise the frame, submission conditions, eligibility rules and evaluation process of such projects.
b) FAPESP and FACEPE will receive joint proposals, covering thematic area of programme CEPS as well as the whole area of environment (as defined by the keywords of programme Blanc International / Environment, Earth and Space) , within their call for proposals “Mudança Climática Global FAPESP/FACEPE”, and will encourage submission of French-Brazilian projects.
b.1) FAPESP and FACEPE will precise the frame, submission conditions, eligibility rules and evaluation process of such projects.
c) The French applicants must comply to ANR’s elegibility rules for research grant applications.
d) The Brazilian applicants must comply to FAPESP’s and FACEPE’s elegibility rules for research grant applications.
e) The French scientists will be subjected to ANR rules and the Brazilian scientists will be subjected to FAPESP’s or FACEPE’s rules, according to their institutional ties.
f) The joint proposals must be unique, i.e., written jointly by the French and Brazilian partner applicants that will collaborate.
g) The joint proposals shall be submitted simultaneously, by the Brazilian applicants to FAPESP and/or FACEPE, and by the French applicants to ANR.
h) The joint proposals shall be written in English.
i) Two types of binational projects are eligible:
i.1) Binational proposals involving simultaneously French teams, teams from the State of São Paulo, and teams from the State ofPernambuco:
i.2) Binational proposals involving French teams and teams from the State of São Paulo or from the State ofPernambuco;
j) Joint proposals not submitted to all Parties involved in the requested funding will not be eligible.
k) After the closure date of the ANR call, ANR will send to FAPESP and FACEPE a copy of applications received at ANR.
l) After the closure date of their joint call, FAPESP and FACEPE will send to ANR a copy of applications received at FAPESP and FACEPE.
m) Each joint proposal must have a Principal Investigator in France, one inSão Pauloand/or one in Pernambuco, designated in the forms submitted to each Party.
2.1 Proposal formatting
a) Each Party will use its own submission forms to receive the joint proposals.
b) Each joint application shall include at least the following appendices (in English):
- Joint abstract (no more than one page in length)
- Joint research plan (no more than 15 pages), which shall include
- A description of the added value to be expected from the collaboration
- A clear description of the planned research collaboration (distribution of work and methods of implementation)
- Responsibilities of the partner teams
- Joint budget of the joint research project, including separate budgets for each partner team fromFrance,São Pauloand Pernambuco. The separate budget of each team shall be prepared according to the specific regulations of the respective funding agency (ANR, FAPESP or FACEPE). Justification for all items to be funded shall be stated in the research plan.
- A description:
- of the project’s significance to researcher training and to the development of the research environment
- on the expected outcome of the proposed project, scientifically as well as in terms of its relevance for the industry and society
- on the ongoing activities and specific advantages of the French research team and the Brazilian research teams fromSão Pauloand Pernambuco, which form the basis for the proposed joint project;
- how the project is expected to help strengthen research cooperation betweenBrazilandFranceover the longer term;
- Discussion on how the proposed joint project compares with other comparable activities worldwide.
- Discussion on how the intellectual property and know how arising from the accomplishment of the joint research project will be handled
- Curricula vitae of the Principal Investigators of the three partner research teams (France,São Paulo and/or Pernambuco), with basic information on education, past and present positions, membership in relevant organizations/associations (maximum of 1 page for each CV)
- Lists of five (5) best papers and other publications of the Principal Investigators of the three partner groups.
3 Evaluation of Project Proposals
a) ANR, FAPESP and FACEPE will implement evaluation of the proposals according to their own evaluation rules, and will rank the proposals based on scientific quality and interest.
b) The most important evaluation criteria:
b.1) Scientific quality and innovativeness of the joint research plan
b.2) Added value to be expected from the French-Brazilian research collaboration
c) Other important evaluation criteria:
c.1) Feasibility of the joint research plan
c.2) Competence and expertise of the French and Brazilian research teams
c.3) Balanced cooperation between the French and Brazilian teams
d) Based on the scientific evaluation, national ranking and consensus reached through discussions, the Parties will agree on the joint projects to be funded.
4 Funding
a) For the selected joint proposals, ANR will fund the part to be developed by French scientists, and FAPESP and FACEPE will jointly fund the part to be developed by Brazilian scientists fromSão Pauloand Pernambuco.
b) The funding will follow the specific regulations of each Party, and may include research expenses, salaries when applicable, fellowships for PhD, Master and undergraduate students when applicable, post doctorate positions, and travel expenses.
c) The funding decisions will be made independently, but based on the mutual agreement, according to the Parties’ respective rules, regulations and practices.
d) Each project will be funded for a period of two to four years.
e) The Parties agree to fund the joint projects on a balanced basis, i.e. with similar amounts forFranceandBrazil.
f) The joint funding from FAPESP and FACEPE for the Brazilian team in a joint project can reach a maximum of 500,000 € per project. Accordingly, ANR agrees to fund the French team in similar amounts.
g) ANR will not earmark special funds to support the proposed French/Brazilian projects since the joint proposals submitted to this program will compete with local proposals received by the ANR national programmes “Changements Environnementaux Planétaires et Sociétés” or “Blanc International / Environment, Earth and Space ”.
h) FAPESP and FACEPE will not earmark special funds to support the proposed French/Brazilian projects since the joint proposals submitted to this program will compete with local proposals received by the FAPESP-FACEPE Programme.
i) The number of Brazilian/French projects selected for funding will strongly depend on the number and quality of the submitted projects. However the Parties expect to fund at least one and up to four French-Brazilian projects.
5 Timetable and Announcement of Decision
The timetable and deadlines are slightly different for the programme Blanc international and the CEPS programme. However, parties agree to ensure that all decisions on proposals to be funded will be taken according to the following common timetable:
- · Beginning of January 2011: publication of the call
- · End of March-mid April 2011: deadline for the submission of joint proposals
- · May-September 2011: national evaluations phases
- · October 2011: ANR/FAPESP/FACEPE decision and publication of results
- · November/December 2011: Notification of grants and projects start
The Parties will synchronise the communication on the selected projects.
6 Intellectual Property
a) The Parties have no claims on the ownership of Intellectual Property Rights arising from the funded projects, but some Parties might have claims over economical benefits arising from such IP rights that applies only towards the benefits realised by the actors they funded.
b) Intellectual property rights belong to the researcher and/or to his/her employing institution. The Parties encourage scientists and their institutions to enter into agreements to ensure the effective protection and correct distribution of intellectual properties resulting from projects funded under this Memorandum of Understanding.
c) A Collaboration Agreement will need to be in place and reported to ANR, FAPESP and FACEPE before any grant notification will be made.
7 Reporting
In addition to the reporting rules of each party,
a) The Principal Investigators, on behalf of their participating teams, will submit to the three Parties a common brief mid-term scientific progress report on the overall project complemented by a brief report from each team.
b) At the end of each project a formal final report should be submitted to each Party according to its reporting rules.
c) Due acknowledgement of support received from the ANR, the FAPESP and/or the FACEPE should be made in the publication of any research resulting from this program.
8 Miscellaneous
a) Each Party covers its own administration costs regarding its contribution to the call, unless otherwise jointly decided.
b) This Memorandum of Understanding is subject to the availability of funds in the budget of the Parties and the applicable laws and regulations of their respective countries.
c) This Memorandum of Understanding is drawn up in English and all documents and notices and meetings pertaining to this Memorandum of Understanding shall be in English.
d) This Memorandum of Understanding may only be amended by a document signed by the three Parties and identified as an Addendum to this Memorandum of Understanding
e) The Parties shall maintain the highest ethical and legal standards in funding research under this Memorandum of Understanding.

9 Term of this Memorandum of Understanding
a) For each Party, the MoU will come into force on the date of signature by the Party’s authorized representative and shall remain in force until the end of the funded projects.
b) The MoU may be amended or modified by written agreement of all signatories or their substitutes.
c) ThisMoU is amutual statement of intent among Parties, who agree to make every reasonable effort to fulfill the intentions expressed herein.
